A national first
Introducing a national first, the Fox Creek Stream Mitigation bank. Managed by Fox Creek Mitigation L.L.C., this bank is the first in the nation to help mitigate developmental impacts to streams by conserving another stream – Fox Creek in western St. Louis County. It is also an efficient tool for developers encountering unavoidable impacts to other streams during development projects.
Fox Creek is one of the few remaining healthy streams in the St. Louis, Missouri area. Sampling by the Missouri Department of Conservation and Stream Teams have verified its health by finding a diverse community of fish, good water quality, and diverse invertebrate community.
The Fox Creek bank works similar to other banks already used to mitigate wetland damages. Fox Creek Mitigation L.L.C. has purchased a section of Fox Creek frontage and adjacent land to help conserve the creek. They are also in the process of restoring eroding portions of creek bank and establishing a forested riparian corridor.
These conservation investments can be reimbursed to Fox Creek Mitigation L.L.C. by sectioning the bank into credits (measured in acres) and selling them to developers of projects needing to mitigate for stream damages. However, each section would remain part of the bank and be deed restricted for conservation uses only. Once all acreage credits are sold, the bank can be donated to a public agency to use as a park, recreational or educational area.
Through negotiations with the U.S. Army Corps of Engineers, Fox Creek Mitigation L.L.C. has established over 197 credits to be sold. This bank is open to service developers with projects in Franklin, Jefferson, and St. Louis counties, primarily in the Meramec and Big river watersheds. Developers outside this area may gain permission to utilize the Fox Creek bank from the U.S. Army Corps of Engineers.
